REGULATIONS OF THE ONLINE STORE ADALBERTSTEA.COM

I. GENERAL PROVISIONS

  1. Online Store available at the following address: www.adalbertstea.com is run by the company Adalbert's Limited Liability Company with its registered office in Warsaw (registered office address and delivery address: Działkowa Street 121 A, 02-234 Warsaw), entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000505307, registration court: District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the KRS, NIP: 5252581861, REGON: 147190452.

  3. These Regulations are addressed to both consumers and entrepreneurs using the Online Store.
  4. The Seller is the controller of personal data processed in the Online Store. Details regarding data processing, cookies, and marketing tools (including Google Analytics 4, Facebook Pixel, Klaviyo) can be found in the Privacy Policy.

II. DEFINITIONS

  1. CLIENT – (1) a natural person with full legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, to which the law grants legal capacity – which has concluded or intends to conclude a Sales Agreement with the Seller.
  2. CONSUMER – a natural person performing a legal act with the Seller not directly related to his or her business or professional activity.
  3. ORDER FORM – electronic service, an interactive form available in the Store enabling the placement of an Order.
  4. ORDER – a declaration of intent of the Customer submitted via the Order Form and aiming directly at concluding a Product Sales Agreement with the Seller.

III. TECHNICAL REQUIREMENTS

  1. To use the Online Store, you must have: a device with Internet access, a web browser and an active e-mail account.
  2. The Seller provides services electronically (Account, Order Form, Newsletter). The terms and conditions for canceling electronic services are specified in the store's functionalities (e.g., the "unsubscribe" link in the newsletter).

IV. CONDITIONS OF CONCLUDING THE CONTRACT AND INVOICING

  1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form.
  2. The prices of the Products visible in the Store are gross prices (including VAT) and are expressed in Polish zloty.
  3. INVOICING PROCEDURE AND MANDATORY NIP:
    1. A customer wishing to receive a VAT invoice for a company (B2B) is obliged to provide the correct Tax Identification Number in the dedicated field when placing the Order.
    2. The "NIP" (or "VAT ID") field is intended solely for entering the correct tax identification number (sequence of digits).
    3. If the Customer enters any other data in the Tax Identification Number field (e.g. company name, comments, the word "none", a string of random characters) or an incorrect number, the sales system will automatically classify the transaction as a consumer sale. In such a case, a fiscal receipt or a personal invoice without a Tax Identification Number will be issued.
    4. Pursuant to Article 106b, Section 5 of the VAT Act, if a receipt is issued without a Tax Identification Number (NIP), there is no legal option to later issue a VAT invoice to the taxpayer. Any subsequent requests to add a NIP number will be disregarded.
  4. The customer agrees to receive invoices in electronic form (PDF file) to the e-mail address provided.

V. PAYMENT AND DELIVERY

  1. The Seller provides the Customer with the following payment methods:
    1. Electronic payments and card payments (payment operators visible in the shopping cart, e.g. Przelewy24, BLIK, PayPal).
    2. Cash on delivery (if available for the chosen delivery method).
  2. The Product is delivered within the territory of the Republic of Poland by courier.
  3. Personal collection of goods is not possible in the Store. All sales are made via mail order.
  4. The standard delivery time is 1 to 5 business days.

VI. RIGHT OF WITHDRAWAL FROM THE CONTRACT (RETURNS)

  1. The consumer may withdraw from the contract within 14 calendar days without giving any reason. The period begins upon delivery of the Product to the consumer.
  2. To meet the withdrawal deadline, it is sufficient to send information (e.g. by e-mail to the store's address) before the deadline expires.
  3. REFUND:
    1. In the event of withdrawal from the contract, the Seller shall refund to the Consumer all payments received from him, including the costs of delivery of the goods (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery method offered by the Seller).
    2. The Seller will refund the payment immediately, and in any case no later than 14 days from the day on which it was informed of the Consumer's decision.
    3. The Seller may withhold reimbursement until the item has been returned or proof of having been sent back has been provided.
  4. The consumer bears the direct costs of returning the goods (the cost of sending the parcel back).

VII. COMPLAINTS

  1. The Seller is obliged to deliver to the Customer a Product that is in accordance with the contract (free from defects).
  2. In the event of non-conformity of the goods with the contract, the Consumer has the rights specified in the Consumer Rights Act.
  3. Complaints can be submitted electronically to the store's e-mail address or in writing to the registered office address.
  4. The Seller will respond to the Customer's complaint immediately, no later than within 14 calendar days from the date of its submission.

VIII. FINAL PROVISIONS

  1. Contracts are concluded in Polish.
  2. The Seller reserves the right to amend the Terms and Conditions for important legal or organizational reasons. Customers with accounts will be notified of any changes via email.
  3. In matters not regulated by these regulations, the provisions of the Civil Code and the Consumer Rights Act shall apply.
